TERMS AND CONDITIONS FOR USING APPLICATIONS AND SERVICES OF PT. METANOTECH ADVANCED SOLUTIONS
1. Introduction
Welcome to Metanotech. We are a provider of Enterprise Resources Management (ERM) services, which includes software applications, hardware assembly services, big data software maintenance, tools analysis, and other related services. By accessing or using our applications and services, you agree to comply with the terms and conditions set forth below. If you do not agree with these terms, please do not continue using our applications or services.

2. Definitions
- Services: The services provided by Metanotech, including Enterprise Risk Management (ERM) applications, hardware assembly, big data software maintenance, tools analysis, and other services related to risk management.
- User: An individual or company that accesses and uses the applications and services provided by Metanotech.
- Hardware Assembly Services: Services for providing, installing, and assembling hardware according to user requirements.
- Big Data Software Maintenance: Services for maintaining and managing software used for big data analysis.
- Tools Analysis: Analytical tools provided to assist companies in risk management and data analysis.
3. User Rights and Obligations
- User Obligations: Users are required to:
- Use the applications, hardware, and other services for lawful purposes and not cause harm to others.
- Respect Metanotech’s intellectual property rights and not copy, modify, or distribute software and other materials without permission.
- Pay service fees in accordance with the applicable rates and fulfill related obligations.
- User Prohibitions: Users are prohibited from:
- Accessing unauthorized data or systems or damaging the integrity of the provided applications, hardware, or software.
- Using our services for unlawful purposes, including the distribution of viruses, malware, or other harmful activities.
- Modifying or damaging the hardware or software provided by Metanotech without written permission.
4. PT. Metanotech Advanced Solutions Rights and Obligations
- Metanotech’s Rights: We reserve the right to:
- Modify, add, or remove features of the applications and services at any time without prior notice.
- Suspend or limit user access if a violation of these terms and conditions is found.
- Adjust service fees in accordance with company policies, including fees for hardware assembly and software maintenance.
- Metanotech’s Obligations: We are responsible for:
- Providing our applications and services with the best possible quality as described.
- Maintaining the confidentiality of user data according to the applicable Privacy Policy.
5. Using the Applications and Services
- User Registration: Users are required to register an account to access the applications and services. Users are responsible for the security of their account and password.
- Hardware Assembly Services: Metanotech provides hardware assembly services according to user requirements. Users agree to provide the necessary information to ensure the service is performed correctly and according to specifications.
- Big Data Software Maintenance: The big data software maintenance service is provided to ensure that systems and applications run optimally. Users must follow the maintenance procedures set by Metanotech.
- Tools Analysis: Users can access the provided tools for data analysis and risk management. Users agree to use these tools in a lawful manner and in accordance with the applicable terms.
6. Payment, Price Increases, and Service Cancellation
- Service Fees: Services provided by Metanotech are subject to fees according to the selected package, which includes ERM applications, hardware assembly, software maintenance, and tools analysis. Payment is made through the agreed-upon methods.
- Price Increases: We reserve the right to adjust service fees, including prices for applications, hardware assembly, and software maintenance, in line with operational cost changes or company policies. Price increases will be notified to users at least 30 (thirty) days before the price change takes effect. Users who do not agree with the price increase may choose to terminate the service according to the cancellation procedure.
- Service Cancellation: Users may cancel their subscription or service at any time through account settings or the provided procedure. Cancellation will be processed in accordance with the applicable terms, and no fees will be refunded if the service has been used.
7. Security and Data Protection
We are committed to protecting users' personal information. Data collected will be used for the operational purposes of the service and will not be disclosed without permission, except as required by law in Indonesia.
- Data Storage: Metanotech is committed to maintaining the security and confidentiality of user data for the duration of the service. We will retain data only for as long as the service is active.
- Data Deletion After Service Cancellation: After the service is canceled by the user or by Metanotech, we will delete all user data stored in our systems. User data will be stored for a maximum of 3 (three) months after the service cancellation, after which it will be permanently deleted from our system.
- Data Deletion Notice: We will not separately notify users about data deletion after the 3-month period ends. Therefore, users are advised to back up important data before the 3-month period ends.
- Exemption: In certain cases, if required by applicable laws or regulations in Indonesia, user data may be retained longer, in accordance with legal obligations. In such cases, users will be notified about the extended data retention.
8. Limitation of Liability
Metanotech is not responsible for:
- Direct or indirect damage arising from the use of applications, services, hardware, or software.
- Service disruptions caused by external factors such as natural disasters, system failures, or other technical disruptions.
- Data loss caused by user error in using the application or service.
9. Dispute Resolution
Any dispute arising from the use of this application or service will be resolved first through mediation. If mediation fails, the dispute will be resolved through arbitration conducted by the Indonesian National Arbitration Board (BANI) in accordance with the laws of Indonesia.
10. Changes to Terms and Conditions
We reserve the right to change, update, or revise these terms and conditions at any time. Any changes will be implemented after being notified to users via the application or registered email. Users who continue to use the application and services after changes are considered to have accepted the modifications.
11. Force Majeure
Metanotech is not responsible for delays or failures in providing services caused by events beyond our control, such as natural disasters, network disruptions, or government regulations that affect our services.
12. Account Closure
We reserve the right to suspend or close user accounts that are found to violate these terms and conditions or engage in activities that harm the company or other users.
13. Governing Law
These terms and conditions are governed by the laws of the Republic of Indonesia. Any issues arising will be resolved based on the applicable laws in Indonesia.
